    farmers & unavailable forms

    Have several forms required for farmers returns that are not yet available by IRS. Will farmers be panalized for not filing by the end of the month if the forms are not available to them.???

      One Is The

      NOL worksheet, and I believe there was one more that affected my farmer. Release date is set for the 27th, but who knows if it will be released...

        I didn't know the IRS had tentative release dates. Are we talking about forms not available from the IRS, or forms not available in a specific software package?

          Has been advising release dates on certain forms, and in some cases the release dates have been suspended.

          Example was form 8606 was to be released on 2-13-09, however was delayed to 2-27-09, then released on about 2-18-09

            Underpayment Penalty

            If the forms really aren't available by the early due date for farmers and fishermen, I would file an extension and make payment with the extension form in order to show good faith.

            Then, if necessary, fight the penalty on the back end. There are specific instructions on how to request a waiver of the penalty. You can find this in the instructions for Form 2210-F, or in Pub. 505. But the IRS hasn't even released an updated version of Pub. 505.

            If the forms are not available, that's a pretty good basis for seeking a waiver of the penalty, especially if most or all of the tax due was paid with an extension by the early due date.
