    collect unemployment?

    I was asked this question last week. I'm not sure of the answer so I thought I would put it out here and see the response.

    An S corporation, concrette construction company, is having a very difficult time. They have laid off all employees, don't have any work. Can the shareholder/employee collect unemployment?
    Corporation is required to pay into unemployment fund for all employees including the shareholder/employee. If he has paid into fund, why can't he draw unemployment?

    I have been asked this a couple of times. I don't know the answer. But it is unfair to have to pay into a fund that you can never collect from.

    It's perfectly legal in NC. The owner/shareholder may be held to a little higher standard of proof that they are actually out of work (which is an understandable & reasonable requirement IMO) but it can be done here.

      It can be done in Arkansas. My wife did it when her business sold.

      Only in government or politics is a "cut in spending" really an increase. It's just not as much of an increase as they wanted it to be, therefore a "cut".
