I was asked this question last week. I'm not sure of the answer so I thought I would put it out here and see the response.
An S corporation, concrette construction company, is having a very difficult time. They have laid off all employees, don't have any work. Can the shareholder/employee collect unemployment?
Corporation is required to pay into unemployment fund for all employees including the shareholder/employee. If he has paid into fund, why can't he draw unemployment?
I have been asked this a couple of times. I don't know the answer. But it is unfair to have to pay into a fund that you can never collect from.
