    Home Buyer Credit

    If you bought a home after Jan. 01, 2009 is the new $8,000 home buyer credit available on the 2008 tax return?

      Are you referring to the $7,500 "credit"? If so - yes, you can claim it on the 2008 tax return or on the 2009 tax return.

            The new $8,000 tax credit (refundable, no payback) is available on either the 2008 or 2009 tax return if the home was purchased after 1/1/09.

                Yes, forgot to add that. All recaptured if house sold within 3 years of purchase.

                      I haven't found any information to confirm or dispute this and I have one client who purchased a home in January 2009 and was going to elect the 2008 $7,500 credit, but the $8,000 with no payback would be better, especially if the no payback applies.

                      If it goes on line 69 will there be a revised Form 5405?

                          IRS computers will probably have to be reconfigured for the new credit. I would just sit tight until you hear further about when they can accept it.

                            As I understand it, if you took the $7,500 on 2008 return and you purchased the home in 2009, you can amend the 2008 return and get the 8,000.

                              wouldn't that be double dipping? if you amend you would only get the difference between the 8000 and 7500.=500
