You are mistaken
The stimulus payment was an advance on a new credit for 2008. People who received less stimulus than their 2008 credit are entitled to receive the balance as a credit on their 2008 return. The daughter is a textbook case of this. On the other hand, people who received more stimulus than their 2008 credit are not required to pay back the difference and her parents are a textbook case of that.

Recovery Rebate Credit
If she did not receive the payment in 2008 and is entitled to it now, yes she can get the RRC on her tax return. The way the credit is structured, it does not matter her parents already got money last year - I have had a number of cases like this already.Leave a comment:

parents claim daughter and grandson as dependents, and receive stimulus rebate for them in 2008.
Daughter filed 2007 taxes but only to receive a refund.
Daughter is filing for 2008 and is claiming her son, is she still entitled to the recovery rebate?
I am thinking no because the parent have already received it?
am I correct???
