    Wife is married and separated for a year or more. Dad is in prison. 2 children-both their's. Wife wants to file as HOH and claim the EIC. This sounds ok. Correct?

    on whether or not she maintained a separate household for those last six months of the year. Or did she move back in with parents?

      Due Diligence

      Used to be an old story about a visitor who wouldn't eat a steak for religious reasons because it was a Friday. The host simply held up the steak and said "Once a steak, now a fish" and the sumptuous meal commenced.

      We had a recent post describing a due diligence penalty on the preparer because he didn't find out the EIC recipient had been in prison.

      IRS promises we don't have to audit clients' tax returns. But we have to perform "due diligence."

      "Once an audit, now due diligence."

        Clairification-Recipient Not in Jail

        For clairification: The spouse is the recipient of the EIC and her husband is in jail.
