    Earned Income Credit - MFS?

    Client has been separated for awhile, not sure how long. Getting a divorce. She has children and might be eligible for the EIC. I assume she probably will have to file as MFS. Is there any exception to this rule (MFS) so she would be eligible for the EIC?

    Only if she qualifies as HOH. Providing home for kids, not one night of the ex in the home last 6 months.
