    Noncompete Income

    Can noncompete income be treated as passive income? Then used to offset rental losses.

      If it is income to the seller due to a non-compete clause in a sales agreement, it is ordinary income.

          Some ordinary income is passive, some is not.

          To answer the OP, no. See Reg. ยง 1.469-2(c)(7)(iv)
