    New 941X

    IRS E-News 1/11/09 has a topic of the new 941X.

    Question: In the instructions for correcting Employment Taxes, it talks about "discovered" before January 1, 2009 and "discovered" after January 1, 2009.

    Does this mean that for the prior 2008 quarters, if we "discover" on 1/1/09 or later we can use the 941X and not have to complete the 941C?

    As I read it, the new 941c pertains only to 941's filed for 1st quarter 2009 forward.
    Corrections to on filed for 2008 backwards still are corrected the old way.

      The key word here is "discovered". As of now (1/1/2009) ANY 941 that needs to be corrected a 941X should be used. The law was written before 01/01/09 so 2008 941s could still be corrected with 941c up to 12/31/08. After that (01/01/09) 941X is the only form to be used, regardless of the 941 year.

      That is the way I read this.

        Sandy, Bob hit the nail on the head! Anything discovered now is after 1-1-09 and the new form would be used.
