    Military Retirement Lump Sum Payment

Client receives a military pension. It is his only source of income and has been low enough in the past few years to not meet filing requirements.

Now, the military has reviewed the pension. They say it was calculated wrong. They have given him a lump sum payment of about 50,000 to cover prior years. (much like Soc. Sec. does).

Is anyone aware of a law that would allow him to claim the money received in each prior year. (like Soc Sec)? The 50,000 in one year is a pretty good hit.

Sorry for the hit but the pay is taxable in the year it was received. Does it qualify for a direct transfer into an IRA? taxea
