A 6 year old son and his working adult parents live with the 55 year old working single grandfather in the grandfather's home. Can the grandfather file HOH claiming the grandson as his qualifying child (but not his dependent)? If he can't use the child can he use his married daughter (the mother of the grandson) as his qualifying person?

Qualifying child of both

Keep in mind that even though the parents are working, they _may_ not be contributing to the household expenses.

Grandfather may claim HoH if...
I agree with Bill Tubbs. The 6 year old child is the qualifying child of both the grandfather and the child's parents. If the grandfather is paying more than half the cost of keeping up the home, and he claims his grandson as his dependent, then he can us HoH status.
There's a big catch to this. The grandfather can't claim the six year old child as a dependent unless the child's parents agree. Because if the parents claim the same child, that will trigger the tiebreaker rules. Natural or adoptive parent trumps all other relationships in a tiebreaker.
