    Divorce mess....

    I have a client that was married for only a few months.... He refuses to sign the state tax return for the state where she lived. He did sign the federal return and the return for his state. She had me put the address of her current address on the return, since if there was a problem she wanted to be notified herself. His reason for not signing the return is he wants the address changed to his address. She has a refund coming from her withholding. This is from 2006 and they are still not agreeing on how to file.... Any suggestions???? He did the federal and his state return himself and filed jointly. Not he claim there was no marriage and is considering having the marriage annulled. Then why did he fild Married Filing Jointly, huh?? Should I have her file an amended return as MFS for Head of Household? Then we don't have to worry about his signature....since he claims there was no marriage anyway?? Hard to believe the man is a pastor, huh??

    Reminds me of a trick I used to do back in my good old ice cream shop days.

    Boyfriends/girlfriends would never agree on who gets to pay. So say they each had $20 and each wanted to pay. It'd take the $40, and make change from $40 using different bills (so I kept both their $20's and gave them a different $20 so that none of it was "their" money) and laid the change on the counter.

    The point being it made it go from being my choice to being their choice.

    How does that relate to your situation? Well, if he wants the address to be his and she wants the address to be hers one possible situation is to preparer it both ways. Include a **** good cover letter explaining that one or the other needs to be filed and it's entirely up to them which gets filed, and that both were prepared to allow them the choice/whatever.

      I like David's solution. Another would be to hand everything back to them and tell them to let you know when they agree on how it's to be done.

        Were any of the MFJ returns done actually filed? If so you cannot amend to MFS. If you do client as MFS how does he have any claim to part of her MFS refund? If they agree to do fed MFJ many states still allow for MFS on the state return.taxea
        Believe nothing you have not personally researched and verified.

          Then you can amend her to be single or HOH if there are children. Even if the marriage is annulled years later you can still amend all open years.

            Perhaps you could have the check sent C/O her attorney. Then, a third party would be involved in proving when and what was received.

              Exes don't agree

              When Exes don't agree or are arguing, I refer them to their attorneys to work things out and then come to me.

              I won't get in the middle of their mess. That is what they hire attorneys for.
