    Is a 2848 Required ?

    Never had a competency issue before. Hope this doesn't sound like really dumb post but apparently a really dumb guy is posting it......
    Dad (MFJ) is now in a nursing home and is, according to a state social worker, incompetent to understand the filing of his tax return.
    2 daughters from a prior spouse are named as his P/O/A's in a doc prepared by his lawyer 27 years ago. Although this P/O/A doc specifies that
    his daughters have the right to file his Federal tax return and handle any such tax matters that are needed, it seem to lack the specifics required
    required in section 601.503(a). The daughters are circling the water. They are ignorant of tax requirements and are treating me as their adversary,
    repeatedly questioning why the 2848 is needed. I'd just as soon disengage from this case but I've been with the wife forever & would rather not
    throw her under the bus. Rapid Robert had graciously provided me with IRS bulletin issue # 2022-03, which settles this for me, but they can't seem
    to grasp why it is necessary to submit a form 2848 "if a daughter P/O/A would only be signing the 8879". They are reluctant to cooperate.
    Anybody else have this happen & how did you handle it.? Thanks for replies.
