The mere fact she claims herself is not controlling - is she a dependent of the parents?
IRC 6428 says a taxpayer is ineligible for the RRC if he/she is allowable as a dependent to another taxpayer.
The determination of dependency is a matter of fact - not a matter of choice.Leave a comment:

Also, we are not all subject to Due Diligence, only Circular 230 professionals are, or when touching those specific instances where the law explicitly calls for it, such as Refundable Credits & HOH filing status (Form 8867).Leave a comment:

Be careful not to take unethical advantage of this Recovery Rebate - we are all subject to Due Diligence.

Last year was 2020. You state she was claimed by her parents.
Then you state “ In 2020 she is claiming herself...” So are you saying both the parents are claiming the student and the student is claiming herself?Last edited by TAXNJ; 02-10-2021, 04:27 PM.Leave a comment:

Are you preparing the return, or is she? If you are, you need to determine if the box "Someone can claim you as a dependent" applies by looking at relevant data. If you prepare the return and don't check the box because she doesn't want it to be so, well......Leave a comment:

Stimulus Payments
I have a 20 year college student who last year was claimed as dependent by her parents. In 2020 she is claiming herself.. Can she claim in addition to $600.00 stimulus and the $2,000.00 payment issued in 2020 under the Recovery Rebate CreditTags: None
