I have researched this and believe it is taxable, but just want to run this by any OK preparers.
Missouri resident receives income from Sac & Fox Nation. I believe this is casino revenues, but would need to confirm with the client. She does not live in OK or on an Indian Reservation.
I think if she lived on a reservation it would be tax exempt, but since she doesn't it's taxable OK source income.
Per OK DOR, non residents must file a tax return if they have OK source income of $1,000 or more. The income from Sac & Fox Nation is just barely over the threshold ($1,035) but appears to be generating OK tax of $29.
So, it appears client needs to file an OK non-resident tax return.
Second issue... she has received this income for years. Do past years need to be amended? Some years she received right at $1,000, other years it was substantially higher, $1,700 or more. Or from a cost/benefit analysis, do you just wait for a discrepency letter from OK and address it then?
