    Truck driver in another state

I have a truck driver who lives in California, and drives to different states, he stayed in the state of Indiana, for 54 days waiting for a load, does he get the per diem for those days since he was away from his tax home??
    thanks

It's the nature of the profession to have to wait for a load, so yes, I'd go with it.
