    Exemption of widow on health care

    Taxpayer died April 2017 and Spouse was covered under TP health insurance while he was living and employed. May thru Dec spouse had no income and did not have health insurance. They file a MFJ return for 2017. I am trying to get an hardship exemption for spouse from May thru Dec as she had minimal income but software looks at total income for both and they are not below poverty level. Is there a way with MFJ to look at just SP income for hardship exemption? Thank you all, have spent a lot of time looking and can not figure it out.

    the recent research I did tells me she should have applied for insurance, she could have been denied or pending (which might qualify her for exemption). you can try filing MFS to see if that helps. husband earned more than 20,000 in 3-4 months?
    sounds like she has penalty from april to December, unless she files MFS.

      She can apply for a Hardship exemption at Healthcare.gov based on the death, and that is not tied to income:

      If you don't have health coverage, you may have to pay a fee. You can get an exemption in certain cases. Most people must have qualifying health coverage or pay a fee for the months they don’t have insurance. But if you qualify for a health coverage exemption you don’t have to pay the fee
