    premium tax credit

    Mom has 2 children as dependents. One in college and one at home yet. She lists both sons on her return, claims one (father claims the other). The father provides health insurance for the boys. She has insurance through the marketplace.
    I have 2 questions.
    1.) where does the amount on line 1 come from? What does it mean? It isn't the monthly premiums or the advance payment or the amount she paid.
    2) Since she has the boys on her return, does the system think the insurance she has covers the boys too? Is there a place to say that the boys are covered by father. It won't let me put any information in for form 8965.

    She will have to pay back some money and I don't want her to pay back more than she should.

    Line 1 of what?

    Line 1 of Form 8962 should show a family of two (herself and the son she is claiming as a dependent).

    What software are you using? There should be a place to indicate what family member have insurance for which months. It does not go on 8965 if they have health insurance.

        Who/what is deciding who gets to claim the two children as dependents (nights under roof, temporary absence at college, Form 8332, other)??

        Absent further facts, it would appear she has a three-person household and any issues with ACA penalties/credits would have to start from there. I do not know how things get handled when the mom (only) has marketplace coverage (to include Form 1095-A) and her two children, as part of the same household, are covered by NON-marketplace coverage.

        Good luck. Did you try working through the Q&As with the tax software? That's often a useful fall-back for folks who routinely (only) use "forms" method.

          Since everyone on the return has insurance you will not have a 8965.

          Tax family size on 8962 is the number of exemptions claimed on return, which may be different than the number of people actually living in the household. If I'm following correctly, she is claiming herself and one son so tax family size is 2.

            Kathyc2, yes. She files head of household and claims one son. Another son lives with her but father claims that son on his tax return.

            Sorry, FEDUKE404. I should have said she has 2 sons who live with her.

            I called software company and she walked me through it. Explained that line 1 of 8962 just says how many are in household. It doesn't matter what kind of insurance the child had. When you put the amounts in from the 1095-A, the program has the information it needs to figure the amount that has to be repaid in her case.

            I JUST HATE THIS STUFF!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! !!!!!!!
